Disputes

These conditions and provisions shall be subject to the provision of our services and shall be interpreted in accordance with Saudi law, that a natural person who uses any of our services for a purpose may be considered outside his trade or occupation (Hereinafter referred to as "consumer") may depend on the binding provisions of the law of the country in which he habitually resides. In the event of a dispute over the contents or interpretation of these terms and conditions, or in the event of a difference or conflict between the Arabic version and a copy in any other language of these terms and conditions, the Arabic version will be the applicable, dominant and decisive version. The English version is available on our platform (by choosing English) or will be sent to you at your written request. Should the validity of any of these conditions and provisions cease to exist, or in the event that the provision becomes inapplicable or non-binding, you will still be bound by all other provisions. In this case, this invalid clause must be implemented to the maximum extent permitted by the applicable law, and you will at least agree to accept an effect similar to the invalid clause, which is not applicable or binding, given the content and purpose of these terms and conditions.

Credit card or bank transfer

When the option is available and applicable, specific flight providers offer the opportunity to pay the flight reservations (in full or in part and as defined in accordance with the provider's payment policy) to the provider during the booking process through secure online means of payment (all as provided and supported by your bank). Phiin.com handles batches for specific services and products (via third-party batch processors) (meaning batch service) under the flight provider option (Phiin.com will not act as a record dealer in any case at all). The payment will be processed safely from your credit card or debit card to account for the flight provider via a third-party payment processor. Any payment made in favor of the provider of the journey in this manner represents in each case a payment for the value of the attachment (or part of the value) of your party for the service or product specified in the final payment (edit of payment) of such prices (or part thereof) due for payment, and you are not entitled to recover such payments.

For certain rates (non-recoverable) or special offers, please note that payment may be required to the provider by bank transfer (if any) or through your credit card, and therefore may be pre-authorized or resolved (sometimes without the possibility of recovery) when the flight is booked. Please check the details (booking) of your product or service that you have selected in detail to find out which of these conditions before making your flight reservation. You cannot hold Phiin.com liable for any deductions (declared, (alleged), unauthorized or false) by the provider of the trip and no value can be collected or recollected for any authorized and valid deductions by the provider of the trip (including pre-paid rates, non-attendance fees and cost cancellations) on your credit card.

In the event of an unauthorized fraud or use of your credit card by third parties, most banks and credit card companies assume the risk and cover all costs resulting from such fraud or misuse. This may sometimes be subject to receivables (mostly €50 or (equivalent in your local currency)). To be able to compensate you, please ensure that this fraud case is reported by informing your credit card provider (consistent with their reporting rules and requirements) and then please contact us immediately. Please provide us with evidence of the amount deducted (e.g.: Credit card provider policy. This compensation is only applied to credit card bookings made using Phiin.com 's secure servers and when the unauthorized use of your credit card is the result of our negligence or no fault with our secure servers.

Advance payment, cancellation, non-attendance and detailed conditions:

When a flight is booked through the flight provider, you accept and approve the relevant cancellation and non-attendance policy of this provider, and any conditions and provisions Additional service provider (delivery) that may apply to your reservation or during your journey (Including the detailed conditions of the flight provider provided on the platform as well as the internal rules of the provider) including services provided and/or products offered by the tour provider. Please note that certain prices, fees and special offers are not eligible for cancellation, recovery or change. The tour provider may deduct the applicable city/tourism taxes in case of non-free cancellation or non-attendance. Please verify the product (s) or service information carefully for any such condition before making a reservation. Please note that a flight reservation requiring a deposit or payment (in whole or in part) may be cancelled (without specific prior notice or warning) to the extent that the amount/amount (remaining) involved cannot be fully collected at the relevant payment date in accordance with the relevant payment policy for the provider of the trip and reservation. Advance payment and cancellation policies may vary according to each piece, product or service per trip.

Please read the detailed requirements (under the types of flights or at the bottom of each provider's page on our platform) as well as the important information in confirming your reservation for information on additional policies that may be applied by the tour provider (e.g.: with respect to age and insurance requirements, non-refundable policies, surcharges for group reservations, extra beds, no free breakfast, pets and acceptable card types). Late payment, wrong bank, credit card or debit data, invalid credit/debit cards or insufficient funds are your own responsibility and you may not be entitled to refund the amount or any advance payment (non-refundable) unless the provider agrees or allows under the (advance) and cancellation policy.

If you wish to offer, modify or cancel your flight reservation, please refer to the electronic booking confirmation message and follow the instructions contained therein. Please note that you may pay for the cancellation in accordance with the (pre) cancellation and payment policy and the non-attendance of the provider of the flight or are not subject to any payment of any amount paid (in advance). We recommend that the policy of cancellation, (advance) payment and non-attendance of the place of residence be read carefully before the reservation is made and that future payments be verified on time and required for the relevant reservation.

If you experience a late or delayed arrival on the date of registration of arrival or arrival of guests on the following day, make sure that you so inform the provider of the flight (in due course/as a matter of urgency) so that they can determine the expected time for your arrival to avoid cancelling (booking) your flight or paying a non-attendance fee. You will need to use the correct email address to properly complete and secure your reservation, we are not responsible for any (and are not obliged to verify any) false email address, any spell error, mobile phone number or inaccurate or false credit card number.

Any claim or complaint against or in connection with the service of the journey must be sent immediately, or in any case within 30 days after the specified day of consumption of the service or product (e.g., departure date). Any complaint or claim sent after 30 days may be dismissed and the claimant loses the right to any compensation (for damage or costs).

Given the constant price and availability updates, we urge you to make screen footage to support your position when booking (if necessary)

We aim to present suitable search results for you, by providing a dedicated standard classification of tour providers on our platform. You can browse this standard classification and use filters and order in alternative arrangements and thus have the impact ability to customize search results to obtain a classification ranking based on other criteria. We use many algorithms to reach standard classification results, and this process is constantly evolving.

The following variables are defined as the most closely related to an appropriate flight provider, and thus give priority to such variables in algorithms (key variables): record your personal search, the "click-to-show" ratio from the search page to the hotel page ("click-to-show ratio (CTR)"), the number of bookings relating to the number of visits to the tour provider page on the platform ("transfer"), the gross reservations of the tour provider (including cancellations) and the net reservations of the tour provider (excluding cancellations). "Conversion ratio" and "click-to-show ratio" may be affected by several factors (self-contained) including valuation points (total and each category), availability, policies, (competitive) pricing, content quality and specific features of the flight provider. The percentage of commission paid by the flight provider or other benefits provided to us (e.g., through commercial arrangements with the flight provider or strategic partners) may affect the standard classification, as well as the date of payment by the flight provider on time. The tour provider can also influence its rating by participating in certain programs, which may be updated from time to time, such as a program, a preferred partner program and an appearance enhancement tool (the latter two include paying the flight provider for a higher commission).

Do not classify the accommodation offered by the stars. Accommodation shall be determined by its own classifications or by independent third parties specializing in star-by-star classifications (objectively). Displays are presented on the basis of the number of stars (from the lowest to the highest or from the highest to the lowest) provided by providers to. Depending on the (local) rules, star-by-star classifications may be awarded either by a third party (independent), for example a hotel classification body (official) or on the views of private accommodation providers, regardless of objective criteria. It does not impose a formal obligation on star classifications and does not review them. In general, stellar classification is a representation of how accommodation compares with legal requirements (if any) or, if not regulated, sector or industry (standard) standards with respect to the price, facilities or services available (these may vary among States and bodies).

To make it easier for customers to find an option that matches their travel preferences, a quality classification has been required that is previously identified and displayed as yellow squares next to specific accommodation. Quality classification is based on many (more than 400 features) features to ensure comparability of accommodation, which can be divided into 5 main categories: (1) the facilities, amenities and services provided by the residence shall: (2) the construction of the residence, such as the size of the unit, the number of rooms and the capacity of the works; (3) the number and quality of photographs uploaded by the residence; (4) average guest evaluation points as well as some detailed points such as hygiene, which proved important for guests when assessing the quality of some accommodation; (5) Data on previous bookings collected in an anonymous manner (for example, to assess the stellar classification of place of residence)We take all these features into account to determine statistical patterns, and based on these results, machine learning models perform analysis to determine quality classification. Clients who have resided will be invited only to assess their stay in the relevant accommodation and to award evaluation points for certain aspects of their residence or may receive an application for assessment during their stay. The following can be applied to the full evaluation of the guest (including the assessment sent during the stay): (a) upload it onto the relevant flight provider's information page on our platform for the sole purpose of telling (future) clients what you think about the service (level) and the quality of the flight provider. (b) its use and delivery (in whole or in part) previously at its own discretion (e.g., for marketing and promoting or improving our services) on our platform or social media platforms, news releases, special promotional presentations, apps or other owned channels, used or managed by our business partners.

The evaluation of the completed guest (a) and (b) may be downloaded (in whole or in part) to the user and previously submitted at his/her own discretion (e.g., for marketing, promoting or improving our services) on our platform or social media platforms, news releases, special promotional presentations, apps or other owned channels, which are used or managed by our business partners. For the purpose of presenting and maintaining recent evaluations (and hence related evaluations), only evaluations will be presented within a specified period of time (3 months) after stay, and each evaluation will be presented for a limited period (36 months) after deployment. The default order of evaluations will be made according to the date of submission and some additional criteria (such as language and evaluations received for comments), and the order of evaluation of the client providing [always] comprehensive and detailed evaluations (also presented as the "Accommodation Explorer") may be at the top of the list. You have the freedom to choose between different forms of ranking and liquidation (e.g., by audience, history, language and points of assessment). Allows the flight provider the option to respond to the evaluation. We reserve the right to control, reject or remove evaluations at our own discretion in case they violate our evaluation policy. No client is compensated or rewarded for completing the evaluation. The guest evaluation model should be considered as a survey and not include any offers, invitations or other business incentives. Undertakes to do its utmost to monitor and eliminate assessments containing lewd words, names of persons or references to stolen goods.

Phiin.com will not accept assessments that include:

• Lewd words, explicit sex, hate speech, discrimination, threats or violence

• Full names or personal attacks on staff

• Promotion of illegal activities (such as drugs and prostitution)

• Websites, e-mails, addresses, telephone numbers and credit card details

• Politically sensitive comments

Both the flight provider is entitled to terminate their relationship for whatever reason (including breach of contract or bankruptcy filing), taking into account the relevant notice period as agreed between the parties.

Depending on the limitations set forth in these terms and conditions and to the extent permitted by law, we shall be liable only for direct damages suffered, paid or incurred by you due to a defect in our service obligations. Our liability amounts to the total amount of the total cost of reservation as indicated in the electronic reservation confirmation message (whether for one event or a series of related events).

It does not assume responsibility (and relinquishes responsibility) for the use, validity, quality, convenience, physical fitness and due disclosure of the journey and does not provide any undertakings, guarantees or conditions of any kind in this regard, whether implicit, legal or otherwise, including any implied guarantees of trade, ownership, non-violation or convenience for a particular purpose. You acknowledge and agree that the flight provider concerned is solely responsible and bears all responsibility and obligation with respect to the journey (including any guarantees and representations provided by the flight provider). It's not considered a second seller for the trip. Complaints or claims relating to the trip (including with respect to the offer price (private/promotional) or specific policy or requests made by customers) must be dealt with by the flight provider. Vacates its obligation and does not assume responsibility for such complaints, claims and (product) claims.

Whether the flight provider has deducted a fee from you for your trip or if we are facilitating the payment of a fee or price (trip), you agree and acknowledge that the flight provider is at all times responsible for collecting, transferring, withholding or paying the applicable taxes due on the total amount of the (trip) price or fees to the relevant tax authorities. Is not obligated or responsible for the transfer, collection, deduction or payment of the relevant taxes due on the price (s) or the fees of the relevant tax authorities. Does not act as the registered trader for any product or service available on the platform.

By uploading images to our system (for example, adding images with evaluations) You acknowledge and agree that you have copyright to these images and that you agree to the possibility of using the images uploaded by you on their website and on mobile phones or apps, as well as their use in promotional materials and publications. Intellectual property rights

Unless otherwise provided, software for our services, available on our platform or used by our website, and intellectual property rights (including copyright) for the contents of our platform, information about it and materials available on it, are owned by its suppliers or tour providers.
